Unifi 

 

Welcome to our website. These terms and conditions apply to the use of this Website.  By accessing this App, you agree to be bound by the terms and conditions set out below.   If you have any questions relating to these terms and conditions, please contact us at info@unifi.app  before you use to our product.  

This App is owned and operated by Unifi App Limited.  The App is offered subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Unifi’s Privacy Notice, Cookie Notice) and procedures that may be published from time to time on this Site by Unifi (collectively, the "Agreement").

Please read this Agreement carefully before accessing or using the App. By accessing or using any part of the App, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you should not access the App or use any services. 

You may use the services if you:

  • Are a university student, or have applied to a UK university.

  • Are at least 16 years old

  • Agree to our Terms of Conditions and Privacy Policy

  • Are not prohibited by law from accessing our services

  • Haven’t previously been banned or terminated from Unifi.app

 

1. Your Unifi.app Account and App

 

If you create an account, interact or comment on the App, you are responsible for maintaining the security of your information, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with your account. 

You agree that:

  • The Personal Information which you provide when you register as a customer is true, accurate, current and complete in all respects;

    • You will notify us immediately of any changes to the Personal Information by contacting us;

    • You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to do so.

You must not describe or assign keywords to your profile in a misleading or unlawful manner, including in a manner intended to trade on the name or reputation of others, and Unifi may change or remove any description or keyword that it considers inappropriate or unlawful, or otherwise likely to cause Unifi liability. 

You must immediately notify Unifi of any unauthorised uses of your account or any other breaches of security within 48 hours of becoming aware of the breach.  Unifi will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. 

 

2. Responsibility of Contributors

 

If you post material, participate in chats,  post links, comment on posts, or otherwise make (or allow any third party to make) material available by means of the App (any such material, "Content"), you are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software. By making Content available, you represent and warrant that:

    • it is not likely to harass, threaten or abuse anyone..

    • it respects all individuals on the basis of race, religion, nationality, politics, disability, gender, sexual orientation, age or any expression of identity. 

    • it is not used to gain sponsorship, or to petition, campaign, scheme or send chain messages.

    • it does not in any way promote or incite anyone to commit or assist in any unlawful or criminal activity or anti-social behaviour or encourage activities which could endanger the safety or well-being of others.

    • if someone has rights to intellectual property you create, you have either (i) received permission from them to post or make available the Content, including but not limited to any software

    • you have fully complied with any third-party licenses relating to the Content, and have done all things necessary to successfully pass through to end users any required terms;

    • the downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party;

    • the Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;

    • the Content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or chats or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);

    • the Content is not pornographic, does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party;

    • your profile is not named in a manner that misleads your readers into thinking that you are another person or company. For example, your name is not the name of a person other than yourself.

 

Unifi has a zero tolerance policy on any posts made available that infringe the above terms. Unifi will manually refuse or remove any content that, in Unifi's reasonable opinion, violates any Unifi policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the App to any individual or entity for any reason, in Unifi's sole discretion.

Unifi does not facilitate chat links to other messaging apps, because it cannot guarantee the safety of those independent, external chats.

Users who notice any content that violates the Unifi policy or is deemed to be inappropriate by the user have the option to report the user. This can be done by visiting the user’s profile and pressing the report option. Unifi will be immediately notified of the request and will take necessary action within 24 hours. 

 

5. Responsibility of App Users 

 

Unifi cannot reasonably review all the material posted to the App, and cannot therefore be responsible for that material's content, use or effects.  While we will use reasonable endeavours to verify the accuracy of any information we place on the App, we make no warranties, whether express or implied in relation to its accuracy.  By operating the App, Unifi does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. 

You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The App may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. 

The App may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. Unifi disclaims any responsibility for any harm resulting from the use by visitors of the App, or from any downloading by those visitors of content there posted.

 

6. Content Posted on Other Websites

 

We cannot review, all of the material, including computer software, made available through the websites and webpages to which Unifi.app links, and that link to Unifi.app. Unifi does not have any control over those non-Unifi websites and webpages and is not responsible for their content or their use. By linking to a non-Unifi app or webpage, Unifi does not represent or imply that it endorses such app or webpage. 

You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Unifi disclaims any responsibility for any harm resulting from your use of non-Unifi websites and webpages.

 

7. Copyright Infringement and DMCA Policy

 

As Unifi asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by Unifi.app violates your copyright, you are encouraged to notify Unifi in accordance with Unifi's Digital Millennium Copyright Act ("DMCA") Policy. Unifi will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material.

Unifi will terminate a visitor's access to and use of the App if, under appropriate circumstances, the visitor is determined to be a repeat infringer of the copyrights or other intellectual property rights of Unifi or others. In the case of such termination, Unifi will have no obligation to provide a refund of any amounts previously paid to Unifi.

 

8. Intellectual Property

 

This Agreement does not transfer from Unifi to you any Unifi or third party intellectual property, and all rights, title and interest in and to such property will remain (as between the parties) solely with Unifi. Unifi, the Unifi.app logo, and all other trademarks, service marks, graphics and logos used in connection with Unifi.app are trademarks or registered trademarks of Unifi or Unifi's licensors. Other trademarks, service marks, graphics and logos used in connection with the App may be the trademarks of other third parties. Your use of the App grants you no right or license to reproduce or otherwise use any Unifi or third-party trademarks.

 

9. Advertisements

Unifi reserves the right to display advertisements to you inside the app. We also reserve the right to share certain information with our trusted local venues in order to offer you information and products that may be of interest to you in your university town.

 

13. Changes

Unifi reserves the right, at its sole discretion, to modify or replace any part of this Agreement.

 

It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the App following the posting of any changes to this Agreement constitutes acceptance of those changes.    Unifi may also, in the future, e-mail you to notify you of any changes to our policies, offer new services and/or app features, through pre-consented mailings as detailed in our privacy notice. 

 

14. Termination 

 

Unifi may terminate your access to all or any part of the App at any time, with or without notice, effective immediately, should we suspect any inappropriate and invalid activity. If you wish to terminate this Agreement or your Unifi.app account (if you have one), you may simply discontinue using the App.  

 

15. Disclaimer of Warranties

 

The App is provided "as is". Unifi and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Unifi nor its suppliers and licensors, makes any warranty that the App will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the App at your own discretion and risk.

 

16. Limitation of Liability

 

In no event will Unifi, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: 

      1. any special, incidental or consequential damages;

      2. the cost of procurement for substitute products or services;

      3. for interruption of use or loss or corruption of data; or

 

 

 

 

17. General Representation and Warranty

 

You represent and warrant that

      1. your use of the App will be in strict accordance with the Unifi Privacy Policy. 

      2. your use of the App will not infringe or misappropriate the intellectual property rights of any third party.

 

18. Indemnification

 

You agree to indemnify and hold harmless Unifi, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the App, including but not limited to your violation of this Agreement.

 

19. Miscellaneous

 

This Agreement constitutes the entire agreement between Unifi and you concerning the use of our app and services and they may only be modified by a written amendment signed by an authorised executive of Unifi, or by the posting by Unifi of a revised version. 

Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the App will be governed by the laws of England and Wales. 

By proceeding to use our app, services and purchase our products you agree to the terms detailed within our: -

20. 

Generally. From time to time, Unifi may offer products and services for purchase ("in app purchases") through the App Store or Google Play Store. If you choose to make an in app purchase, you will be prompted to confirm your purchase with the applicable payment provider, and your method of payment (be it your card or a third party account such as the Google Play Store or App Store (your "Payment Method") will be charged for the in app purchase at the prices displayed to you for the service(s) you've selected as well as any sales or similar taxes that may be imposed on your payments, and you authorize Unifi or the third party account, as applicable, to charge you.

Auto-Renewal; Automatic Card Payment

If you purchase an auto-recurring periodic subscription through an in app purchase, your Payment Method will continue to be billed for the subscription until you cancel. After your initial subscription commitment period, your subscription will automatically continue for an indefinite period of time, at the price you agreed to when subscribing unless you cancel your subscription before the renewal date. Your card payment information will be stored and subsequently used for the automatic card payments in accordance with the Agreement.

Objections to a payment already made should be directed to info@unifi.app if you were billed by the relevant third party account such as the App Store. You are also able to object by contacting your bank or payment provider, who can provide further information on your rights as well as applicable time limits. You may unconditionally withdraw your consent to automatic card payments at any time by going to the subscriptions section of the relevant third party account, but be advised that you are still obligated to pay any outstanding amounts.

If you want to change or terminate your subscription, it is easiest to log in to your third party account and follow the instructions to terminate or cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the Unifi application from your device. Deleting your account on Unifi or deleting the Unifi application from your device does not terminate or cancel your subscription; Unifi will retain all funds charged to your Payment Method until you terminate or cancel your subscription on the third party account, as applicable. If you terminate or cancel your subscription, you may use your subscription until the end of your then-current subscription term, and your subscription will not be renewed after your then-current term expires.

Refunds. Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods. We may make an exception if a refund for a subscription offering is requested within fourteen days of the transaction date, or if the laws applicable in your jurisdiction provide for refunds.

21. The discounts supplied via the Unifi app are subject to change and or termination over time depending on the current promotions available to us by third party venues. New discounts are being added all the time and occasionally, current discounts will become void due to circumstances outside of our control. If for any reason, your unifi discount card is not accepted when used at any third party establishment listed on the app at the time of the of the unacceptance, please contact info@unifi.app immediately and we will resolve the situation. You MUST upload a clear image of your face with no background clutter to your unifi discount card to avoid your card being rejected when presented to venues. Unifi ensures that the discounts offered within our app are exclusive and greater than any other student discount in circulation by the third party establishment at the time the discount is arranged between Unifi and the third party establishment. Third party establishments advertised by unifi are within their own rights to refuse discounts and/or entry to individuals based on any behaviour they deem inappropriate, aggressive or abusive.

22. Contact Us

 

These terms and conditions may be changed, and published on our App, by us and we are not under any obligation to notify you of such changes, therefore, please visit this page regularly to check for any updates. 

Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by the laws of England and Wales.
